2. A project concerning access to data on complainants' digital devices

For this project, CPP researchers examined the powers police may use to ask for, take possession of, and extract evidence from the electronic devices of complainants reporting serious sexual offences in England and Wales. In particular, this project examined whether a victim’s consent could provide a legal basis for processing their device data and when such processing would meet legal standards of necessity and proportionality. The report focuses both on pre-existing law, including the Criminal Procedure and Investigation Act 1994 and Data Protection Act 2018, as well as the new Police, Crime, Sentencing, and Courts Act 2022 (PCSC Act) and its associated draft code of practice for police data processing. The report recommends caution is exercised in this developing area of the law generally and suggests further training and guidance on the PCSC Act specifically is needed for frontline police investigators to ensure compliance with these legal standards and the protection of rights, including complainants’ privacy rights.

The Project Managers were Tim Cochrane (a PhD candidate with the Faculty of Law) and Nicholas Goldrosen (a PhD candidate with the Institute of Criminology). The research team consisted of Delene Adams, Georgia Speechly, Harpreet Gupta, Isabelle St-Hilaire and Mayeda Tayyab.
